Régimen jurídico-urbanístico y gobernanza territorial costarricenses: brechas, tensiones y oportunidades para una reforma

Abstract

El artículo examina las brechas estructurales del modelo urbanístico costarricense que limitan la efectividad del derecho urbanístico y de la planificación territorial. Desde un enfoque histórico, jurídico e institucional, se analiza la evolución del sistema vigente, evidenciando los factores que han impedido consolidar una política nacional de ordenamiento coherente y sostenida en el tiempo. El estudio adopta una metodología cualitativa y descriptivo-analítica basada en la revisión de fuentes secundarias —leyes, reglamentos, jurisprudencia, proyectos de ley, informes técnicos y estudios académicos—, con énfasis en el periodo 1949-2025. Los resultados muestran que el marco legal, técnico y operativo continúa fragmentado y anclado en la Ley de Planificación Urbana de 1968, lo que ha generado dispersión normativa, débil rectoría institucional y falta de articulación entre escalas y actores. También se identifican vacíos de capacidad técnica y política en las municipalidades, tensiones interinstitucionales, así como la persistencia de intereses que obstaculizan el avance significativo y reformas estructurales. El trabajo concluye que la transformación del régimen urbanístico costarricense requiere una reforma integral que incorpore principios contemporáneos de gobernanza territorial, función social y ecológica del suelo, y planificación multinivel, orientada hacia un desarrollo urbano-regional sostenible, equitativo y resiliente.

The article examines the structural gaps in Costa Rica’s urban planning model that limit the effectiveness of urban law and territorial planning. From a historical, legal, and institutional perspective, it analyzes the evolution of the current system, highlighting the factors that have prevented the consolidation of a coherent and sustained national territorial policy. The study adopts a qualitative and descriptive-analytical methodology based on the review of secondary sources —laws, regulations, case law, bills, technical reports, and academic studies— with emphasis on the period 1949–2025. The findings show that the legal, technical, and operational framework remains fragmented and anchored in the 1968 Urban Planning Law, generating regulatory dispersion, weak institutional leadership, and lack of coordination across scales and actors. The analysis also identifies technical and political capacity gaps in municipalities, interinstitutional tensions, and the persistence of interests that hinder significant progress and structural reforms. The paper concludes that transforming Costa Rica’s urban planning framework requires a comprehensive reform that incorporates contemporary principles of territorial governance, the social and ecological function of land, and multilevel planning, oriented toward sustainable, equitable, and resilient urban– regional development.
